Thank you for using the Sure2Profit.com Web Site. Within the site we are governed by certain rules relating to the exhibition and sale of works online. Some of these terms and conditions apply to our relationship with you. Our intention here is to set forth these terms unequivocally so that you are aware at all times of our responsibilities to you and vice versa. We assume that by continuing to use the Site, you have read and accepted these terms. Do not use the site if you do not accept these terms and conditions.
These Terms and Conditions contain all of the terms governing the relationship between you and Sure2Profit.com and any variation must be explicitly agreed by us in writing. Any advice, recommendation, representation or other information given by us concerning the products, which is not confirmed in writing is given on an informal basis and shall not form part of the relationship between us. If any provision of these terms and conditions shall be unlawful, invalid or unenforceable, then the remainder of the agreement shall remain valid and enforceable.

RIGHT TO CHANGE TERMS AND CONDITIONS
Sure2Profit reserves the right to change these Terms and Conditions at any time, and those that are available on the Site at the time you are using it, will be those that apply. We therefore recommend that you check from time to time for any changes/updates as notice is deemed given when published on the Internet

Sure2Profit.com expressly prohibit the use of this site for any activity, which is deemed illegal in any jurisdiction.
In connection with our terms and conditions, where we refer to 'Content' we mean all images, photographs, text, information, film, video, and sound contained in, or available from our Site. The images and designs used on the Sure2Profit.com Site, together with all software developed in relation to it, are the property of Sure2Profit.com. All rights are reserved.
Logos are trademarks of Sure2Profit.com. All rights in these trademarks are reserved. Our Site also contains trademarks belonging to third parties, the copyright, trademarks and other rights to which are the property of their respective owners, who in turn reserve all of their rights in respect thereof. You may not use or reproduce any trademarks appearing on our Site for any purpose without the prior agreement of the relevant owner.
 
REPRODUCTION, DISTRIBUTION AND MODIFICATION
Reproduction, Distribution and Modification is expressly prohibited for any purpose without express written agreement from Sure2Profit.com or that of the relevant Content owner in question.
 
CUSTOMER AND USER PRIVACY AND DATA PROTECTION
All and any information provided by you to Sure2Profit.com will be treated in strict confidence with respect to privacy and according to the terms and conditions of the Data Protection Act. We do not share this information with any third party either than our payment processor company, SafeCharge.com.
 
LIABILITY
Sure2Profit.com shall not be deemed liable for any personal loss or damage, which may arise from the use of any of the information contained in the Site. Sure2Profit.com does not exclude liability for death or personal injury resulting from our negligence.

INDEMNITY
You agree to indemnify Sure2Profit.com and keep Sure2Profit.com indemnified against any damages, claims, liabilities, losses and expenses arising out of any misuse by you of any part of the web site or information therein.

TERMS AND CONDITIONS OF TRADING
All purchases made from Sure2Profit.com will be regulated by these terms and conditions, so it is important that you read them thoroughly before making any purchase. Please note that your use of our Site constitutes your agreement to follow and be bound by those terms.
 
THE CONTRACT
All orders are subject to acceptance and availability of the goods ordered. Sure2Profit.com is entitled to refuse any order placed by you. No contract will subsist between you and Sure2Profit.com for the sale by it to you of any product unless and until Sure2Profit.com accepts your order by e-mail confirming that it has dispatched your product. That acceptance will be deemed complete and will be deemed for all purposes to have been effectively communicated to you at the time Sure2Profit.com sends the e-mail to you (whether or not you receive that e-mail). All contracts shall be deemed to have been formed in Italy. No one under the age of 18 years old is eligible to make transactions through Sure2Profit.com. 

Sure2Profit.com makes every effort to ensure that all prices and descriptions quoted on the Site or any other medium are correct and accurate. However it is inevitable that errors will occasionally occur. In the event of such an error, Sure2Profit.com will be entitled to rescind the contract and return any monies the customer has paid in respect of the order.
 
SETTLEMENT
All Sure2Profit.com prices are in British Pounds. Value added tax is included in all prices quoted. There is no delivery extra charges and that will be clearly shown before you make payment. Your payment card will be debited in GBP.
We accept electronic payments by Visa, MasterCard, Solo, Visa Electron, Maestro and Switch made via third party secure payment processor SafeCharge.com

Upon signing up for the membership trial, you, the client, agree that Sure2Profit.com will automatically deduct the first payment due from the credit/debit card on file without any further notice when payment is due, if the membership is not cancelled prior to the due date.

When the first payment is due can be found in the membership control panel furthermore an email will be send to the customer upon completion of the purchase containing the following information.

Thereafter membership fees will be automatically deducted from the credit/debit card on file on a monthly basis without any further notice until cancelled by the member from his own membership control panel.

The due date for any membership/ trial recurring payment can be found in the user membership control panel, the date shown is the date the payment will be deducted from the credit/ debit card Sure2Profit has on file at 7 AM UK time.

The due date of any recurring payment is set to be charged the day after a Membership/ trial ends at 7 AM UK time, the due date can be found in the User membership control panel, accessible after loggin-in at: http://www.sure2profit.com/amember/member.php .
 
Sure2Profit.com retains the right to modify the prices from time to time, however this does not apply to previous membership fees, which will remain unaltered for as long as the customer stays subscribed.
 
CANCELLATIONS
Memberships/Trials may be cancelled at any time; unless they have been made to your specification or when we have started any other agreed service in writing.
Under the Consumer Protection (Distance Selling) Regulations 2000, you may cancel the Membership/Trial at any time by clicking the "cancel" link in your Membership area control pane accessible after loggin-in at: http://www.sure2profit.com/amember/member.php  and follow instructions. The membership/trial will expire the day before your next payment is due and no further action is required. 
Sure2Profit.com will send you an immediate email to let you know that your cancellation has been processed. If this is not received it is customer’s responsibility to inform Sure2Profit hereof in writing.

Sure2Profit staff is not in control over cancelling your membership: cancellation must be done by you, the customer, via the membership control panel  to avoid any misunderstandings. Should in special cases Sure2Profit be required to cancel your subscription on your behalf, this shall be done in a written request sent via Fax to the number: +44-2070001285, giving at least 3 business days to execute the request. However Memberships will be deemed cancelled when the company has acknowledged the cancellation request.

Any cancellation will end Sure2Profit.com liability to you.

REFUNDS
Since Sure2Profit.com is offering non-tangible irrevocable goods we do not issue refunds after the product / service is delivered , which you are responsible for understanding upon purchasing anything at our site. If under certain circumstances we might decide to issue a refund this will be at our complete discretion, but if this is issued prior to the stated guarantee time on any of our product sale pages, there will be a 16.5% admin charge deducted off the full price paid to cover our merchant expenses. However, all this does not appy to the Membership service, which under no circumstances what-so-ever will be refundable. The foregoing does not affect your statutory rights.

MEMBERSHIP SERVICE
The Sure2Profit Membership selections might vary from day to day and are provided every day from Monday to Friday (Saturday and Sundays excluded). However, due to the nature of this service and certain events which are out of our control, such as no suitable races, sickness, electrical failures etc. you agree that in case of such events the service might be interrupted for a period of up to 5 working days without any refund being provided. Sure2Profit also reserves the right to change the amount and type of selections given according to what is believed to be the best for our service and our members without any notice.

The information provided shall not be distributed, shared or published in anyway without prior written permission. Any members found to be passing information on to relay services, third parties or non members will have their membership cancelled immediately without any refund and legal action will be pursued whenever required.

The information is provided "as is". Sure2Profit.com shall not be liable to you or any third party for any loss or damage, direct, indirect or consequential, arising from (i) any inaccuracy or incompleteness in, or delays, interruptions, errors or omissions in the delivery of the data or any other information supplied to you through this Website or (ii) any decision made or action taken by you or any third party in reliance upon the data.
Sure2Profit.com will not be liable for loss of business resources, lost profits or any punitive indirect, consequential, special or similar damages whatsoever, whether in contract or tort or otherwise, even if advised of the possibility of such damages incurred by you or any third party.

CREDIT CARD SAFETY
Sure2Profit.com intends to provide you with the safest and most secure shopping experience possible. Our secure payment service provider use the latest technology to protect your credit card information and does not release it to any outside organisation under any circumstances. Orders are placed using 256bit ultra secure encryption (SSL - the Internet standard for secure transactions). Sure2Profit.com only stores a limited amount of customers’ data, which are encrypted and not accessible by any members of its staff.

DISCLAIMER
This site and all contents of the site are provided on an "as is" basis without warranties of any kind, either express or implied, including without limitation warranties of title or implied warranties of merchantability or fitness for a particular purpose. You acknowledge, by your use of the site, that your use of the site is at your sole risk, that you assume full responsibility for all costs associated with all necessary servicing or repairs of any equipment you use in connection with your use of our site, and that Sure2Profit.com shall not be liable for any damages of any kind related to your use of this site including any economical loss that might have incurred by using any of our services, systems and software.

HOLIDAYS
The tipster service will not be running on Sundays and Public Holidays / Bank Holidays. However, we do guarantee the service during the rest of the year around without any interruption due to personal holidays.

INTELLECTUAL PROPERTY
Copyright and Intellectual Property Rights remain with us (or other Copyright owner) even after you buy a personalised work. Purchase of any work from Sure2Profit does not grant you any right other than that of ownership of the product. STRICTLY NO REPRODUCTION ALLOWED.

GOVERNING LAW
These Terms and Conditions are therefore governed by Italian law and all parties agree to submit to the non-exclusive jurisdiction of the Italian Courts.

NON-DISCLOSURE AGREEMENT
This agreement is made between “the user” and “Sure2Profit.com”. This Agreement shall govern the conditions of disclosure by “Sure2Profit.com” of certain "Confidential Information" including but not limited to drawings, data, trade secrets and intellectual property relating to our digital products created by Sure2Profit and distributed by “Sure2Profit.com” or any third party with which Sure2Profit.com has made a similar arrangement WHEREAS the parties, for their mutual benefit, may already have exchanged and wish further to exchange certain information of a confidential nature and wish to protect such information in the manner set out in this Agreement.
In return for valuable consideration, with regard to the Confidential Information, the user hereby agrees:
1. The user hereby agrees not to use the information therein except for personal use of our “Informational Products”.
2. To safeguard the information against disclosure to others with the same degree of care as he exercises with his own information of a similar nature.
3. Not to disclose the information to others or to whom it might be of commercial interest, without the express written permission of Sure2Profit.com. The holder shall be prevented from using or disclosing any of the information: which are not in the public domain, public knowledge other than through acts or omissions of “the user”.
4. That the secrecy obligations of “the user” with respect to the information shall continue for a unlimited period from the date hereof or when such information is made public by Sure2Profit.com.
This Agreement constitutes the entire agreement and understanding between the parties in respect of Confidential Information and supersedes all previous agreements, understandings and undertakings in such respect. This Agreement cannot be amended except by written agreement signed by all parties or by their authorised signatories. The interpretation construction and effect of this Agreement shall be governed and construed in all respects in accordance with the laws of Italy and the parties hereby submit to the non-exclusive jurisdiction of the Italian Courts.
Sure2Profit.com will be entitled to obtain an injunction to prevent threatened or continued violation of this Agreement, but failure to enforce this Agreement will not be deemed a waiver of this Agreement. If either party shall break any of the terms of this agreement the party in default shall indemnify and keep indemnified the other from and against all costs, claims, demands, liabilities, expenses, damages or losses, (including without limitation consequential losses and loss of profit, and all interest, penalties and legal and other professional costs and expenses) incurred or suffered by them by reason of or in connection with any such breach.

DIGITAL SIGNATURE:
At time of purchasing a product from Sure2Profit.com, before completing the sale we might require you to sign electronically that you understand and agree to our website “Terms and Conditions”. This is an authorized contract by federal law under the "Federal Digital Signature Act" of June 30, 2000.

For the protection of both consumers and merchants, recent legislation by various states, countries and credit-card associations recognize the legality and enforceability of binding digital signatures. Your electronic signature and the information recorded at the time of purchase, including information you provided to us such as your name, address, and credit-card information, is combined with other recorded information to form a portion of your digital signature. This other recorded information includes, but is not limited to, your geographic location, your internet service provider, your ip address, related information that may be traced back to your caller-id phone number (where available), the exact date and time, and other identifying information in order to dispute any claims or attempt of chargebacks from Client and take legal action to cover the expenses the dispute might have incurred.

POLICY ON CHARGEBACKS:
• Client understands that Sure2Profit.com does not tolerate fraudulent chargebacks and will proceed to collect by any means necessary.
• Client is responsible for attorney's fees, fees for collection agencies or third party intervention if client fraudulently charges back or does not pay monies owed.
• If Client charges back fraudulently, client will owe £500 plus chargeback fees plus amount owed.
• Sure2Profit.com will report any outstanding balances to the three main credit bureaus.
• Sure2Profit.com will have the incident reported to anti-fraud databases, which will attempt to prevent any further purchases on the Internet.
• Sure2Profit.com has a chargeback legal department and will file suit if necessary.
